Please read this document carefully.  By signing, you acknowledge that you understand and voluntarily accept its terms, including the release of certain legal rights.
 

1. Intensive, Released Parties and Assumption of Risk

“The Intensive” or "Intensive" means The Professional-Minded Drummer Intensive and all related instruction, workshops, rehearsals, demonstrations, performances, breaks, travel between locations, social gatherings and other Intensive activities.
 

The “Released Parties” include The Professional-Minded Drummer Intensive, Fredrock School of Drumming, participating instructors, staff members, guest clinicians, contractors, volunteers, sponsors, photographers & videographers, venue and property owners, and their representatives and affiliates.
 

I voluntarily choose to participate and understand that The Intensive activities may involve physical activity, repetitive movement, lifting equipment, loud sound, travel, and the use of drums, cymbals, hardware, cables, stands, electronics, and other equipment.  Risks may include slips, falls, muscle strain, repetitive-motion injuries, hearing damage, illness, equipment-related injury, property damage, actions of other participants, and other known or unforeseen hazards.
 

I knowingly and voluntarily accept and assume all risks associated with my participation.

2. Release and Waiver of Liability

To the fullest extent permitted by Idaho law, I release, waive, discharge, and agree not to sue the Released Parties for claims, injuries, losses, damages, costs, or expenses arising from or relating to my participation in The Intensive, including claims caused by the ordinary negligence of a Released Party involving instruction, supervision, facilities, premises, equipment, or The Intensive activities.
 

This release does not apply to gross negligence, reckless or intentional misconduct, or liability that cannot legally be waived.  I understand that by signing this Agreement, I am giving up certain legal rights.​

3. Safety, Medical Responsibility, Transportation and Property

I agree to follow reasonable safety instructions, use instruments and equipment responsibly, and report unsafe conditions, injuries, or damaged equipment.
 

I understand that loud sound may cause temporary or permanent hearing damage.  I am responsible for using appropriate hearing protection and determining whether I am physically and medically able to participate safely.
 

The Intensive does not provide medical insurance.  I am responsible for medical treatment and expenses arising from my participation.  If I am unable to provide consent during an emergency, I authorize The Intensive staff, venue personnel, or emergency responders to arrange reasonably necessary emergency assistance.  I am responsible for transportation to, from, and between The Intensive locations and assume the risks associated with that travel.  I am also responsible for my instruments, equipment, electronics, vehicles, and other personal belongings.  The Released Parties are not responsible for property that is lost, stolen, or damaged, except where liability cannot legally be waived.

4. Code of Conduct

I agree to behave professionally, respectfully, and safely throughout The Intensive.  Disruptive, abusive, discriminatory, illegal, intoxicated, or unsafe conduct may result in removal without refund.
 

I may be held financially responsible for damage caused by intentional misconduct, reckless behavior, or unauthorized use of property or equipment.

5. Media Release

I authorize The Professional-Minded Drummer Intensive, Fredrock School of Drumming, and their authorized staff and representatives to photograph, film, and record my image, likeness, voice, and participation during The Intensive.  I authorize these materials to be edited and used without compensation for promotional, educational, advertising, social-media, website, email, and archival purposes. I understand that materials may be made public and remain available online.​

6. Governing Law and Acknowledgment

This Agreement is governed by Idaho law.  Any legal action relating to The Intensive or this Agreement shall be brought in a court serving Ada County, Idaho, unless otherwise required by law.  If any provision is found unenforceable, the remaining provisions will continue in effect.
 

By signing the consent form, I acknowledge that I have read and understand this Agreement, voluntarily assume the risks associated with The Intensive, understand that I am releasing certain legal claims, including claims arising from ordinary negligence, certify that I am at least 18 years old, and sign voluntarily.​
